What is the Commentary and what authority does it carry?
The Commentary is not the regulations themselves; it is an explanatory text written by FIFA on the Regulations on the Status and Transfer of Players to clarify the purpose of each article and the manner of its application. Its structure follows that of the regulations: after general considerations and definitions, each article is commented on separately — including article 18 on special provisions relating to contracts.
The practical value of the Commentary lies in its incorporation of the jurisprudence of FIFA's judicial bodies and the Court of Arbitration for Sport within the commentary on each article. The reader therefore sees not only the text of the article, but the reading given to it in actual cases.
Important warning on the temporal validity of this edition
This is the second edition and dates from 2021. On 28 November 2023 FIFA published the third edition of the Commentary, which covers subsequent amendments to the regulations as well as more recent jurisprudence of the FIFA Football Tribunal and the Court of Arbitration for Sport.
In a case whose subject matter arose after 2023, reliance on the commentary in this edition is not prudent; it must be checked against the third edition. For events in the years 2021 to 2023, however, this text is the authoritative official commentary.
Who this document matters to
Clubs, players and agents involved in international transfers, and lawyers handling cases on contract termination, compensation and sporting incentive, are the principal audience. In Iranian cases brought before the FIFA Football Tribunal, the Commentary is the most frequently used document in support of argument — provided that the correct edition is selected.
