Examining the ethical disciplinary case of Mark Overmars, manager of Ajax

Introduction

The disciplinary case against Marc Overmars, the former sports director of Ajax Amsterdam, is an interesting and instructive example for sports law students and lawyers active in this field. This case, which led to the issuance of a disciplinary decision by the Dutch Institute for Sports Law (Instituut Sportrechtspraak), briefly called ISR, and subsequently the FIFA Disciplinary Committee, contains important points regarding dealing with ethical violations and sexual harassment in football and how to apply FIFA's disciplinary regulations.

It should be noted that in the Netherlands, the ISR acts as the disciplinary committee for most Dutch sports federations.

Familiarity with the details of this case and the approach of disciplinary authorities in handling it is important for sports lawyers in several ways. First, this case emphasizes the need for serious and decisive action against ethical violations, especially sexual harassment in the sports and football environment. Protecting victims and preventing the recurrence of such behaviors requires disciplinary sports authorities to send a clear message to the sports community by applying appropriate and deterrent penalties. In this regard, Mr. Overmars' significant ban from any football-related activity for two years (one year of which is suspended) confirms the disciplinary authorities' firm resolve to deal with such violations and send a deterrent message to the football community.

Secondly, this case affirms the importance and position of FIFA's disciplinary regulations in the sports legal system, especially football. To effectively defend the interests of their clients and provide accurate legal advice, lawyers and sports jurists must study and master the provisions of these regulations and how they are applied by FIFA disciplinary committees.

In the present case, the Dutch Football Federation's reference to Article 70 of the FIFA Disciplinary Code and the request to extend the sanction worldwide, as well as the FIFA Disciplinary Committee's arguments regarding the fulfillment of the conditions stipulated in this article to agree with the aforementioned request, indicate the importance of these regulations in determining the final outcome of disciplinary cases. Therefore, for lawyers and sports attorneys, familiarity with the details of FIFA's disciplinary regulations and practical examples of their application will be very necessary and helpful.

Moreover, Mr. Overmars' case is also instructive in terms of the interaction between national and supranational (FIFA) disciplinary bodies. National football federations, as the main pillar of the football system in each country, play an important role in prosecuting and handling disciplinary offenses. However, in cases like the current one where the severity and importance of the committed offense necessitate it, it is possible to use the capacity of FIFA regulations to extend the punishment globally. This, while increasing the deterrence of disciplinary sanctions, ensures that the offender cannot escape the consequences of their behavior simply by leaving a jurisdiction or the territory of a national federation, and will remain subject to punishment. Analyzing this aspect of the case is also useful and necessary for sports lawyers.

Overall, a careful study of Marc Overmars' disciplinary case, focusing on FIFA's disciplinary regulations, opens a window for sports law students and lawyers in this field to become familiar with the most important legal and practical aspects of combating disciplinary offenses in football. In the continuation of this article, focusing on the contents of the FIFA Disciplinary Committee's decision as well as Article 70 of this body's disciplinary regulations, we will explain the details of the case and analyze its legal dimensions.

Facts of the Case

According to the decision issued by the Disciplinary Committee of the Dutch Institute for Sports Law (ISR Disciplinary Committee) on November 16, 2023, Marc Overmars violated Article 6, paragraph 10 of the Regulation prohibiting any sexual communication through mass communication means by sending messages and images of a sexual nature to some employees of Ajax Amsterdam club. According to this decision, the sanction of a two-year ban for Mr. Overmars from holding any position in the Dutch Football Federation or affiliated organizations was imposed, one year of which was suspended for two years. In other words, one year of the ban was definitive and the other year was conditional on not committing a similar offense within the next two years.

The ISR Disciplinary Committee stated in its decision that although Mr. Overmars denied committing any violation, the evidence and documents provided by the complainants were sufficiently indicative of the veracity of the allegations made against him. Therefore, the aforementioned committee, by establishing the occurrence of the alleged violation, proceeded to issue a conviction verdict and impose a temporary ban.

Given the nature and severity of the offense committed, the Dutch Football Federation (KNVB) on November 24, 2023, and through the FIFA Legal Portal, submitted a request to the FIFA Disciplinary Committee for the worldwide extension of the disciplinary decision issued against Mr. Overmars. In this request, which included a copy of the said decision along with its English translation, the Dutch Football Federation pointed out that the present case pertained to Mr. Overmars sending sexual messages and images to athletes and employees of Ajax club, and the disciplinary committee, by establishing the violation of relevant regulations, considered the sanction of ban for him.

On December 11, 2023, in response to the inquiry of the secretariat of the FIFA Disciplinary Committee, the Dutch Football Federation (KNVB) provided additional explanations regarding the details and manner of implementing the imposed sanction. According to these explanations, Mr. Overmars' two-year ban begins from the date of the decision (November 16, 2023), which includes a one-year unconditional ban and another year of conditional ban with a two-year probationary period. As a result, the definitive part of the ban will end on November 16, 2024. The Dutch federation also emphasized that until then, no appeal had been received against the decision.

Subsequently, the Dutch federation provided the FIFA Disciplinary Committee with copies of correspondence with Mr. Overmars regarding the notification of the disciplinary decision and informing about submitting the request for worldwide extension of the sanction to FIFA. The aforementioned correspondence included the email dated November 16, 2023 for notifying the decision to Mr. Overmars' lawyer, the text of his power of attorney to his lawyer, and the email dated November 23, 2023 for informing about submitting the request for worldwide extension of the sanction to FIFA.

Therefore, what emerges from the set of facts and documents of the case indicates that Mr. Overmars, due to sending sexual messages and images to Ajax club employees and after going through the disciplinary process at the Dutch Institute for Sports Law, was sentenced to a two-year ban from football activities. Subsequently, the Dutch Football Federation, by sending a request to the FIFA Disciplinary Committee, sought the worldwide extension of this sanction based on Article 70 of the FIFA Disciplinary Code, so that through this, the effects and consequences of the decision issued could be applied at the international level and beyond the territory of this federation.

Request of the Dutch Football Federation for Worldwide Extension of Sanction

The Dutch Football Federation (KNVB), in support of its request to the FIFA Disciplinary Committee for the worldwide extension of the sanction imposed on Mr. Overmars, invoked Article 70 of the FIFA Disciplinary Code.

According to the aforementioned article, in cases of serious infringements such as discrimination, manipulation, misconduct against match officials, forgery and falsification, as well as sexual abuse or harassment, national football federations and confederations can request the FIFA Disciplinary Committee to extend the sanctions imposed by them worldwide.

In the submitted request, the Dutch Football Federation, explaining the nature of the committed offense, which pertained to sending unethical and sexual messages and images by a senior club official to employees and players, emphasized the need to seriously confront such behaviors in football. This federation pointed out that the worldwide extension of the sanction issued against Mr. Overmars, in addition to creating effective deterrence, will send this message to the football community that no individual can or should commit such heinous violations by abusing their position and status, and if they do, they will face severe punishments at the national and international levels.

The Dutch Football Federation went on to explain that the decision issued by the Disciplinary Committee of the Dutch Institute for Sports Law was made in compliance with all the procedures of fair trial and principles, and there is sufficient evidence to prove the occurrence of the alleged violation by Mr. Overmars. Therefore, the conditions and requirements stipulated in Article 70 of the FIFA Disciplinary Code, including proper notification of the decision, providing an opportunity for him to defend himself, compliance of the decision with FIFA regulations, and the non-contravention of the worldwide extension of the sanction with public order and accepted standards of conduct, have been fully met.

Examination of the Case by the FIFA Disciplinary Committee

After receiving the request of the Dutch Football Federation to extend the sanction imposed on Mr. Marc Overmars worldwide, the FIFA Disciplinary Committee examined the case in accordance with the relevant regulations. The main topics and stages of this review are as follows:

A- Jurisdiction and Applicable Law:

The FIFA Disciplinary Committee first established its jurisdiction to hear this case. Based on Article 56 of the FIFA Disciplinary Code, this committee has the jurisdiction to handle all disciplinary offenses stipulated in FIFA regulations that do not fall under the jurisdiction of other bodies of this institution. In addition, Articles 70 and subsequent articles of these regulations explicitly refer to the issue of worldwide extension of disciplinary sanctions and stipulate the procedure for handling such requests. Therefore, given the request of the Dutch federation and its nature, there was no doubt about the jurisdiction of the FIFA Disciplinary Committee in this case.

The committee also emphasized that the substantive and procedural laws applicable in the present case, in accordance with Article 5 of the FIFA Disciplinary Code, include the regulations, directives, and decisions of this body and, in a complementary manner, the laws of Switzerland and other laws that the aforementioned committee deems appropriate.

B- Fulfillment of the Conditions of Article 70 of the Disciplinary Code:

The key part of the FIFA Disciplinary Committee's review was to assess the conditions and requirements set out in Article 70 of this body's disciplinary regulations for the worldwide extension of sanctions. Accordingly, the committee had to ascertain that the five conditions stipulated in paragraph 5 of Article 70 were fully met. These conditions are: 1- Properly notifying the sanction to the convicted person; 2- Providing an opportunity for him to defend himself (except in cases of issuing a provisional order); 3- Properly notifying the issued decision to that person; 4- Compliance of the decision with FIFA regulations; 5- The worldwide extension of the sanction not being contrary to public order and accepted standards of conduct.

The FIFA Disciplinary Committee, based on the documents submitted by the Dutch federation and the contents of the disciplinary decision issued in that country, fully established the existence of the first four conditions in Mr. Overmars' case. According to the case file, the aforementioned decision was properly notified to Mr. Overmars and he had the opportunity to defend against the accusations during the proceedings. Also, the text of the issued decision was found to be free of flaws in terms of compliance with FIFA regulations.

However, regarding the fifth condition, i.e., the worldwide extension of the sanction not being contrary to public order and standards of conduct, the committee considered more precise considerations. In this regard, the committee, by carefully examining the contents of the decision and the reasons for its issuance, concluded that the content of this decision is in no way in conflict with fundamental legal principles, ethical standards, and public order, and making a decision regarding the worldwide extension of the sanction will also not have any contradiction with these principles and standards. In other words, not only were the contents of the disciplinary decision against Mr. Overmars compatible with the public order and ethical values governing the football community, but its worldwide extension was also assessed as an action towards safeguarding this order and these values.

C- Not Entering into the Substance of the Violation:

Another important point in the FIFA Disciplinary Committee's review was this body not entering into the substance of the committed violation and being satisfied with examining the formal conditions for the worldwide extension of the sanction. In fact, the committee, based on the principle of the limited scope of disciplinary review in cases of worldwide extension, merely dealt with establishing the conditions set out in Article 70 of the disciplinary regulations and refrained from any re-evaluation of the content of the issued decision and the instances of the alleged violation. Accordingly, the committee avoided examining issues such as the sufficiency of evidence to prove the violation, the proportionality of the imposed sanction, and other substantive issues, and focused its attention on establishing the formal requirements of the request for worldwide extension.

Thus, by adopting a disciplined approach consistent with the regulatory frameworks governing its performance, the FIFA Disciplinary Committee summarized its reviews in Mr. Overmars' case. The result of these reviews indicated that the conditions and requirements set out in Article 70 of the disciplinary regulations for accepting the Dutch federation's request regarding the worldwide extension of Mr. Overmars' sanction have been fully met, and on this basis, the ground for making the final decision by this committee has been provided.

Decision of the FIFA Disciplinary Committee

After conducting the necessary reviews and establishing the case's compliance with the conditions and requirements set out in Article 70 of the disciplinary regulations, the FIFA Disciplinary Committee finally concluded this case by issuing its decision on January 9, 2024. The main points and contents of this decision are as follows:

A- Acceptance of the Request for Worldwide Extension of the Sanction:

The FIFA Disciplinary Committee, considering the set of aforementioned considerations and arguments, while establishing the fulfillment of the conditions stipulated in Article 70 of the disciplinary regulations, agreed with the request of the Dutch Football Federation to extend the sanction imposed on Mr. Marc Overmars worldwide. According to the issued decision, the two-year ban from football activities for him, which was previously issued by the Dutch disciplinary authorities, was recognized as enforceable and binding worldwide and in all areas under FIFA's jurisdiction.

B- Global Implementation of the Ban:

Based on the decision of the FIFA Disciplinary Committee and following the framework of the sanction determined in the decision of the Dutch disciplinary authority, Mr. Overmars was banned from holding any position in all FIFA member associations and their affiliated organizations worldwide for two years from November 16, 2023. It is noteworthy that out of this two-year period, one year is definitive and the other year is suspended and conditional on not committing a similar violation within two years from the date of the decision.

C- Specifying the Decision's Compliance with the Fate of the Dutch Disciplinary Authority's Decision:

The FIFA Disciplinary Committee pointed out in its decision that, according to Article 70, paragraph 11 of the disciplinary regulations, if the decision of the Dutch federation's disciplinary authority, which has been the basis for worldwide extension, is not yet legally final, the decision issued by the FIFA committee will also follow the same fate and legal status. In other words, if for any reason, such as Mr. Overmars' possible appeal against the issued decision, the judgment of the Dutch disciplinary authority undergoes a change or amendment, the FIFA committee's decision will also consequently change and follow the new legal effects and consequences.

Therefore, the decision of the FIFA Disciplinary Committee was in fact a confirmation and worldwide extension of the previous decision of the Dutch football disciplinary authority against Mr. Overmars, which, while respecting the scope of the sanction determined in that decision, made its implementation mandatory in the territory of all FIFA member federations. Thus, the two-year ban (with one year suspension), which initially could only be enforced in the territory of the Dutch federation, was extended to all areas under the sovereignty of this international body by the decision of the FIFA Disciplinary Committee, in order to send a clear message to the football community about dealing with ethical violations and the severe consequences of such behaviors. However, FIFA's decision still has a fate dependent on the final decision of the Dutch authority and will only have its irreversible effects if it becomes final.

Importance and Results of the Decision

The issuance of the FIFA Disciplinary Committee's decision in Mr. Marc Overmars' case is important and has significant results from different aspects, which will be mentioned below:

A- Emphasis on Combating Ethical Violations and Sexual Harassment in Football:

The most important message of the issued decision is the serious commitment of football disciplinary bodies, especially FIFA, to relentlessly combat unethical conduct and behaviors, including sexual harassment, in the field of football. This decision clearly showed that regardless of individuals' position and status, committing such violations will face a decisive response from the competent authorities and will have severe punishments for the offenders. From this perspective, the decision of the FIFA Disciplinary Committee is an effective step towards cleansing football from moral contaminations and ensuring a safe and healthy environment for all stakeholders of this sport.

B- Expanding the Impact of National Federations' Disciplinary Sanctions through Worldwide Extension:

The present decision proved the importance and effectiveness of the mechanism for worldwide extension of sanctions. This mechanism, which is stipulated in Article 70 of the FIFA Disciplinary Code, allows national football federations, in cases of acute and severe violations, to request FIFA to implement the sanction globally while imposing it within their own jurisdiction. Thus, the enforceability and deterrence of disciplinary decisions of national federations are increased, and it prevents the offender from being able to exclude themselves from the scope of the determined sanction by leaving the territory of a federation.

C- Necessity of Sports Lawyers' Familiarity with FIFA Disciplinary Regulations:

Finally, it should be said that the decision of the FIFA Disciplinary Committee in the Overmars case once again highlights the importance of lawyers and sports jurists being familiar with the details and subtleties of FIFA's disciplinary regulations. Sufficient knowledge and mastery of the contents and conditions of applying the articles of these regulations will be very helpful for success in defending the interests of clients and adopting the best approaches in disciplinary cases. Therefore, sports lawyers should further enhance their professional competence in this emerging and important field of sports law by studying similar cases and focusing on relevant rules.

Summary and Conclusion

Overall, the decision of the FIFA Disciplinary Committee in accepting the request of the Dutch Football Federation for the worldwide extension of Mr. Marc Overmars' sanction due to committing ethical violations and inappropriate sexual behaviors is one of the most important recent disciplinary developments in the field of football. While affirming the serious determination of FIFA's disciplinary bodies to deal with such violations, this decision is also an important step towards protecting the ethical health of the sports community.

On the other hand, a careful study of the contents and arguments of the issued decision provides valuable insight to sports law practitioners, especially lawyers and students interested in this field. Understanding the foundations and processes of making such important decisions, as well as having a grasp of the details of FIFA's disciplinary regulations, will be very effective for success in defending similar cases.

Therefore, both in terms of safeguarding ethical and human principles in football and from the perspective of the importance of familiarity with the subtleties of sports disciplinary law, the decision under discussion is of great significance, and studying it is recommended to all enthusiasts. Undoubtedly, FIFA and other relevant sports bodies, by making decisive and fair decisions in such cases, will not only purify the sports environment but also help to enhance the legal knowledge of the sports community.
