One clause, one idea

The added text is short but carries a large idea: participation in establishing a sports arbitration institution in cooperation with the National Olympic Committee and the other federations, so that disputes between clubs, athletes, federations and other persons may be resolved through arbitration and in compliance with the law of civil procedure.

The significance of this clause lies in its context. The global sporting system rests on the referral of disputes to arbitration, with the Court of Arbitration for Sport at its apex; in Iran, however, sports disputes were heard mainly either by the federations' internal committees or before the general courts. This clause was an attempt to build a specialised sports arbitration body at national level.

What became of this clause

The 2002 Statutes, to which this clause was added, were replaced in 2021 by new Statutes. In the new Statutes, the settlement of sports disputes — preferably through negotiation or arbitration — is likewise listed among the federation's functions, and article 28 expressly provides for appeal to the Court of Arbitration for Sport.

This document therefore has historical and interpretive value today: it shows when, and in what formulation, the idea of sports arbitration entered Iranian regulation.

The Council of Ministers, at its session of 12 May 2013, upon the proposal of the Ministry of Sport and Youth and pursuant to the note to article (11) of the Act on the List of Non-Governmental Public Institutions and Organisations — adopted in 1994 — resolved:

The following text is added as clause (23) to article (3) of the Statutes of the Amateur Sport Federations of the Islamic Republic of Iran, being the subject of Resolution No. 4966/T26429H of 26 June 2002:

23 — Participation in establishing a sports arbitration institution in cooperation with the National Olympic Committee and the other federations, in order to make possible the settlement of disputes of sports clubs, athletes, federations and other relevant natural and legal persons through recourse to arbitration, in compliance with the Act on Civil Procedure of the General and Revolutionary Courts in Civil Matters.
