A structural feature with no equivalent elsewhere
These regulations are expressly founded on Hungarian law: Article 14(3) of Act No. I of 2004 on Sport, and Government Decree 39/2004 on sporting disciplinary liability. The reason is that the federation's headquarters are in Budapest. For the sports lawyer this means that in construing ambiguities in this text, Hungarian law is the background — not Swiss law, which is the reference in most international federations.
The three rules of widest applicationArticles 1 to 4
- ScopeThe regulations apply to disciplinary offences and — subject to qualification — to ethical offences, and cover conduct contrary to the ethical principles of judo. The exercise of disciplinary powers in the course of a contest itself falls outside their scope.
- Temporal ruleAn offence is adjudicated under the regulations in force at the time it was committed; but if the new regulations no longer treat that conduct as an offence, the new text governs — the lex mitior rule.
- Limitation period: five yearsAfter five years no disciplinary sanction may be imposed. However, if the victim was a minor at the time of the offence, that period is calculated separately, and if the act is prosecutable for a longer period under the law, the longer period governs.
Who this document matters to
For any athlete, coach or official facing disciplinary proceedings at international level, and for the national federation that, under Article 3, bears responsibility for the conduct of its members. The first question to answer in such a case is which edition the date of the offence makes applicable — the 2019 edition is available in this same family for events before May 2023.
