Law Amending the Legal Bill on the Statute of the National Olympic Committee of Iran
Single Article — The Statute of the National Olympic Committee of Iran, approved on 58.2.15 by the Islamic Revolutionary Council of
Iran, is amended as set out in the annex to this Law, and the Government is authorised to give effect to its provisions until the outcome is received from the International Olympic Committee.
"Statute of the National Olympic Committee of Iran"
Part One — Definition and Purpose
Article 1 — The National Olympic Committee of Iran, referred to in this Statute as the "Committee", is established on the basis of the principles of the Statute of the International Olympic Committee, for the purpose of supporting the Olympic Movement and the Games related to it, as well as amateur sport in Iran.
Article 2 — The National Olympic Committee of Iran is an independent, non-profit organisation, possessing legal personality and financial independence, and free from any racial, religious, political or commercial purposes.
Part Two — Duties of the Committee
Article 3 — The duties of the Committee are as follows:
a — Implementation of the rules and observance of the regulations of the International Olympic Committee
b — Permanent liaison with the International Committee, with the National Olympic Committees of other countries and with the international and continental federations, for the preservation of the Olympic cause and the interests of the country's national sports federations.
c — Presentation of Iran's national federations and sports bodies to international sporting assemblies and protection of their rights.
d — Making the preparations for the participation of Iran's selected athletes in the Olympic and Asian Games.
e — Familiarising the general public with the ethos of the Olympic Games and encouraging them to support the Olympic Games movement.
f — Holding artistic exhibitions connected with the Asian and Olympic Games.
g — Supervising the application of the principles of amateurism in sporting competitions, and endeavouring to familiarise society with the moral values of sport and the observance of the principles of amateurism in schools, clubs and public centres through the use of the mass media
h — Sending the country's representatives to the assemblies relating to the Olympic and Asian Games.
i — Examining and deciding upon infringements or reports received from the national and international federations and international sports bodies against the country's national federations and sports bodies and athletes. The decisions of the Assembly in these matters are binding on Iran's federations and sports bodies.
j — Where necessary, holding training courses, both domestic and international, in Iran in cooperation with the International Olympic Cooperation Committee, the relevant federations and scientific sports organisations (domestic and foreign), and sending individuals to the training courses of the International Olympic Cooperation Committee.
k — Approving and cooperating in the arrangement of the programme for sending the representatives of the national federations and sports bodies, and Iranians who are members of international sports organisations, to international congresses and assemblies at the time of the Olympic and Asian Games, where required.
l — Cooperation in the affairs of the Asian and international sports federations whose offices are located in Iran.
m — Cooperation with the sports federations in order to keep the members of the national teams prepared for dispatch to the Olympic and Asian Games.
n — Examining the statutes and regulations of Iran's national amateur sports federations and reconciling them with the standards and rules of amateurism.
o — Presentation of Iran's representatives to the International Olympic Committee in accordance with the regulations of that Committee.
p — Holding consultative meetings of the presidents and secretaries of the sports federations with the Executive Board of the Committee and with the presidents and secretaries of the confederations based in Iran, once every three months, for the purpose of examining the international affairs of the federations.
q — Compiling and publishing news, books, periodicals and sporting and artistic articles relating to the Olympics and the federations and international technical regulations, and the bulletin of the National Olympic Committee of Iran.
r — Designating one day or one week in the year in the name of the Olympics, in cooperation with the national federations.
4 — Recording and keeping all the records of the Olympic, Asian and world Games, and recording the qualifying standards and the results of the placings obtained.
s — Preparing and keeping medical files for all national champions, in cooperation with the country's Sports Medicine Federation.
Part Three — Organisation
Article 4 — The Committee has the following organs:
a — The General Assembly.
b — The Executive Board.
c — The General Secretariat.
d — The Preparations Committee for the Olympic and Asian Games.
Part Four — The General Assembly
Article 5 — The General Assembly, which is the highest decision-making authority of the Committee and is referred to in this Statute as the "Assembly", is composed of the following individuals and office-holders.
a — Any Iranian who is a member of the International Committee, provided that the election
of that person took place after Bahman 1357 (1 February 1979).
b — The representatives of the sports federations whose sport is part of the programme of the Olympic Games, who constitute the majority of the members of the Assembly:
1 — Basketball Federation of Iran
2 — Judo Federation of Iran
3 — Shooting Federation of Iran
4 — Swimming Federation
5 — Athletics Federation
6 — Rowing and Canoeing Federation
7 — Handball Federation
8 — Wrestling Federation
9 — Weightlifting Federation
10 — Skiing Federation
11 — Cycling Federation
12 — Football Federation
13 — Equestrian Federation
14 — Hockey Federation
15 — Gymnastics Federation
16 — Volleyball
c — The minority members of the Assembly are:
c — 1 — The representatives of the sports federations whose sport has world games or is part
of the sports of the Asian Games.
17 — Federation of the Deaf of Iran.
18 — The Disabled of Iran
19 — Tennis Federation of Iran
20 — Badminton Federation of Iran
c — 2 The representatives of the country's sports institutions.
21 — Representative of workers' sport in Iran
22 — Representative of farmers' sport
23 — Representative of the sport of the Army of Iran
24 — Representative of the sport of university and school students of Iran
c — The representatives of other institutions.
25 — One person from among Olympic medal-winning champions, elected by themselves.
26 — Two persons from among the presidents and secretaries of the continental confederations and the Iranian members of the executive committees of the international federations whose sport is part of the programme of the Olympic Games, provided that their election took place after Bahman 1357 (1 February 1979).
27 — Four persons knowledgeable in sporting affairs and the Olympic Games, presented by the official responsible for sport in the country.
Note 1 — In the event of a change in the positions of the persons named in paragraphs b and c — 1, c 2 and c 3, the new elected or appointed members and individuals will become members of the Assembly in their place.
Note 2 — The National Olympic Committee may have honorary members, admitted to membership from among the friends and supporters of the Olympic Games. These members are admitted to membership in accordance with a special regulation to be approved by the Executive Board, and pay a sum to the Committee as an annual membership fee and receive a special membership card.
Note 3 — The honorary members of the National Olympic Committee may, at the invitation of the Secretariat of the National Olympic Committee, attend the meetings of the General Assembly without the right to vote.
Article 6 — All members of the Assembly must hold Iranian nationality, be of good character and be known for a good record in society.
Article 7 — The term of office of the Assembly is four years, and it shall meet at least once a year. The presence of a majority is necessary for the meeting to be validly constituted, and if a majority is not obtained, a further convocation shall be made within one month, and that meeting shall be held with the members present, and its decisions shall be binding.
Part Five — Duties of the Assembly
Article 8 — The General Assembly, which shall be chaired by the President of the Executive Board, is convened at least once a year; the place and date of the meeting and the agenda of the Assembly must be drawn up by the Secretary General and sent to all members by registered post with acknowledgement of receipt. The agenda of an Assembly held in ordinary session shall include the following items:
a — Approval of the minutes of the previous meeting.
b — Designation of three persons to examine the minutes of the previous meeting and to supervise the conduct of the elections.
c — Approval of the report of the Executive Board and of the Secretary General.
d — Approval of the financial report by the Treasurer and proposal of the Committee's budget to the competent authorities.
e — Proposal of amendments to the articles of the Statute.
f — Election of the Executive Board. President — Vice-Presidents — Secretary General — Treasurer and members.
g — Raising of questions and proposals.
h — Determination of the date and place of the next meeting of the Assembly.
Article 9 — In the case of a proposal to amend the articles of the Statute and in the following matters, half plus one of the members must be present at the meeting of the Assembly:
1 — Amendment of articles or addition of articles to the minutes.
2 — Suspension or expulsion of a member or members of the Assembly.
Note — In matters of decision-making, the vote of the majority shall be valid.
Article 10 — For the election of the members of the Executive Board, voting shall be either collective or separate; the determination of the form of voting shall be by agreement of the Assembly.
Article 11 — An extraordinary meeting of the Assembly shall be convened at the written request of one third of the total members of the Assembly or at the request of the President or the Secretary General. A request by any member for the convening of an extraordinary meeting of the Assembly must be submitted to the Secretariat of the Committee two months before the date of the requested Assembly, and the notice of convocation, the place of the meeting, its date and its agenda must be communicated to all members at least one month before the date on which the Assembly is held.
Article 12 — The Secretary General of the Committee is required to draw up the minutes of the Assembly and to send them to the members.
Article 13 — All decisions of the Assembly shall be enforceable immediately upon their approval and their communication to the interested authorities.
Article 14 — The Assembly has an agenda for its session, and proposals must reach the General Secretariat two months before the session of the Assembly is held in order to be placed on the agenda. At the session of the Assembly, the reports of the Secretary General and the Treasurer are also examined.
Article 15 — The Secretary General is required, at least fifteen days before the Assembly is convened, to send the agenda of the session and the proposals received to the members for their information.
Article 16 — The following persons may not be elected to membership of the Assembly:
a — Professional sportspeople.
b — Persons who are connected with and engaged in sport for personal gain (other than persons who, as an occupation, continuously receive a salary from sport by this means).
c — Any person who holds a coaching position in sporting competitions and receives money.
Article 17 — The service of all members of the Assembly is honorary and they receive no remuneration or reward in return for their services, but while on mission they shall have the benefit of travel expenses and a subsistence allowance in accordance with the applicable rules.
Article 18 — The Committee may deprive of membership any member of the Assembly who has acted contrary to the laws in force in the country or has in any way damaged the interests, standing and dignity of the Committee, or who has for some reason forfeited the qualification for membership, and may elect a successor in accordance with the provisions of this Statute.
Part Six — The Executive Board
Article 19 — Within two months at the latest after the Olympic Games, the Assembly shall elect the Executive Board of the Committee from among its own members for a period of four years (one Olympic cycle).
Article 20 — The Executive Board of the Committee, the majority of which is elected from among the representatives of the sports federations (six persons), has eleven members, as follows:
a — The President of the Executive Board, who shall also chair the Assembly.
b — Two Vice-Presidents.
c — The Secretary General.
d — The Treasurer.
e — Six members.
Article 21 The re-election of the members of the Executive Board in subsequent terms is not prohibited.
Part Seven — Duties of the Executive Board
Article 22 — The duties of the Executive Board are as follows:
a — The Executive Board shall be responsible for all the administrative, financial, technical and international affairs of the Committee.
b — The Executive Board shall meet at least once a month, and extraordinary meetings may be convened upon prior notice from the Secretariat.
c — Election of the officers and members of the sub-committees and supervision of their acts.
d — Election of the country's representatives to the International Olympic Committee and its congresses and to the meetings of the Asian Games Council, and of the representatives of the national federations to world assemblies, and consideration of all matters relating to the meetings of the general assemblies of the international and Asian federations in which Iran's representatives hold membership.
Article 23 — The President of the Executive Board shall direct the meetings of the Board and, where necessary, of the sub-committees. In the event of an equality of votes, the vote of the President shall be decisive.
Article 24 — Should the President of the Board be unable for any reason to perform their duties, or in their absence, or in the event of their resignation or withdrawal, one of the Vice-Presidents shall assume the performance of their duties until a new President is elected.
Article 25 — The President of the Executive Board, together with the Treasurer and the Secretary General, shall sign all the financial documents of the Committee.
Article 26 — The President of the Executive Board and the Secretary General of the Committee may attend all meetings of the sub-committees and of the assembly of presidents and secretaries of the federations, and other related meetings.
Part Eight — The General Secretariat
Article 27 — The Secretariat of the Committee, which is administered under the supervision of the Secretary General, has responsibility for the conduct of administrative affairs and the execution of the approved budget, and the Secretary General has full authority to carry out all the executive affairs of the Committee with the approval of the Executive Board. The Secretariat is required to prepare all the internal and external correspondence of the Committee and to submit it for the signature of the Secretary General, and to supervise closely the proper conduct of administrative and correspondence affairs, as well as the keeping and safekeeping of records and documents, the drawing up of the minutes of the Assembly and of the Executive Board and the related agendas, and finally the coordination of all the affairs of the Committee.
Note — The employment affairs of the staff and personnel of the General Secretariat are governed by a regulation approved by the Assembly.
Article 28 — The Treasurer of the Committee shall participate in and supervise the collection of membership fees, financial assistance and gifts, and shall also endeavour and strive in the collection of the Committee's receivables and credits and in increasing the relevant revenues, shall supervise the proper conduct of the Committee's accounting affairs and the keeping of the relevant books and documents, and shall prepare and draw up the annual balance sheet and the examination of the budget for submission to the Assembly.
Part Nine — The Preparations Committee for the Olympic and Asian Games
Article 29 — The Executive Board shall elect the members of the Preparations Committee for the Olympic Games and the Asian Games from among the members of the Assembly and of the Executive Board or from other qualified persons. This Committee shall, in cooperation with the relevant federations, take the necessary measures for making the preparations for the participation of Iranian athletes, providing the means of travel, securing the site of the training camp, and administering and supervising the affairs of the champions and their accompanying personnel at the continental and Olympic Games.
Article 30 — The Preparations Committee shall be constituted at least eighteen months before the start of each Olympic Games or Asian Games, and its term of operation is for that edition of the Games only.
Article 31 — The views of the Preparations Committee shall be implemented after approval by the Executive Board of the National Olympic Committee of Iran.
Article 32 — The Preparations Committee is composed of seven persons, as follows:
1 — One President (from among the members of the Executive Board).
1 — One Vice-President.
3 — One Secretary.
4 — One Treasurer.
5 — Three members.
Sub-committees
Article 33 — The Executive Board of the National Olympic Committee of Iran shall, upon the proposal of the Preparations Committee and for a specified period, establish the following sub-committees for the carrying out of the preliminary work and for expediting matters relating to the participation of athletes and the preparation of the participating personnel:
a — Committee for Preliminary Competition Affairs.
b — Committee for Public Relations and Publications.
c — Committee for Financial Affairs, Planning and Budget.
d — Committee for Coordination and Supervision.
e — Committee for Health and Medicine.
f — Judicial and Disciplinary Committee.
Article 34 — The Executive Board of the National Olympic Committee of Iran shall determine and communicate the number of members and the duties of each sub-committee, so that it may perform its functions under the supervision of the Preparations Committee.
Article 35 — Each sub-committee shall have one officer in charge.
Article 36 — The Preparations Committee shall, upon the proposal of the officer in charge of the sub-committee, elect the members of the committee from among the members of the Assembly or from qualified persons, and, after approval by the Executive Board of the National Olympic Committee of Iran, shall issue the letters of appointment.
Article 37 — The officers in charge of the sub-committees are required to submit each month a full written report on the progress of the respective committees to the Preparations Committee, so that, after examination, it may be brought by the Secretariat to the attention of the Executive Board of the National Olympic Committee of Iran.
Article 38 — All members of the Executive Board of the National Olympic Committee of Iran may attend the meetings of the Preparations Committee and of the sub-committees, and the Secretary General shall exercise general supervision with a view to coordinating the programmes.
Article 39 — For cooperation and coordination in matters relating to the preparation and selection of the athletes participating in the Olympic and Asian Games, consultative meetings shall be held with the presence of the presidents of the federations participating in the Games and of the Preparations Committee and the sub-committees, and views shall be sought and coordination effected with a view to the better performance of matters.
Article 40 — At the conclusion of the Olympic and Asian Games, the representatives of the Preparations Committee who have taken part alongside the participants in the Games for the purposes of administration and supervision shall prepare a full report on the manner of work and the aptitude of the champions and the representatives dispatched, and on the progress achieved in each sporting discipline, and shall submit it to the Executive Board of the National Olympic Committee of Iran, so that it may be raised at the meeting of the Assembly and appropriate decisions taken.
Part Ten — Budget of the National Olympic Committee of Iran
Article 41 — The budget of the National Olympic Committee of Iran shall be drawn up by the Treasurer in cooperation with the Secretary General and submitted for the approval of the General Assembly.
Article 42 — The revenues of the National Olympic Committee of Iran are as follows:
a — The appropriation provided from government assistance; and, having regard to the rules of the International Olympic Committee, no interference on account of this assistance which would impair the freedom of this Committee shall be accepted.
b — Financial assistance given by individuals or organisations.
c — Revenues from pre-Olympic competitions.
d — Donations or gifts paid by individuals or institutions.
e — Revenues collected by the Committee in holding the Olympic day or week.
f — Revenues derived from the sale of stamps and sporting coins and Olympic and Asian emblems.
Article 43 — All revenues shall be expended with the approval of the Executive Board, and the balance sheet thereof shall be presented to the General Assembly.
Article 44 — The financial affairs and undertakings of the National Olympic Committee of Iran shall bear two of the three signatures set out below:
a — The President or the Secretary General.
b — The Treasurer.
Article 45 — The Executive Board may, for the purpose of cooperation, invite as advisers the former heads of the Physical Education Organisation and the former Secretaries General of the National Olympic Committee of Iran and the former presidents of the sports federations, and persons who have in one way or another rendered services in the advancement of sport and the aims of the Olympic Movement.
Article 46 — Where necessary, for the amendment of the articles of this Statute, proposals shall be raised in the Executive Board of the National Olympic Committee of Iran and referred to the General Assembly for its opinion, so that they may be sent, through the Council of Ministers, to the Islamic Consultative Assembly for approval.
Article 47 — This Statute, consisting of ten parts and forty-seven articles and five notes, was approved at the session of 1360.4.3 of Commission No. 21 (Organisations Affiliated to the Prime Ministry) of the Islamic Consultative Assembly, pursuant to Article 85 of the Constitution.
The above Law, comprising forty-seven articles and five notes, was approved pursuant to Article eighty-five of the Constitution at the session of the third of Tir of the year one thousand three hundred and sixty of the solar calendar by the Commission for Organisations Affiliated to the Prime Ministry, and the honourable Guardian Council has confirmed it; it is enforceable on an experimental basis for a period of two years from the date of approval.
